1. What is the regulation governing registration of establishments in Tamil Nadu?
- By virtue of Section 3 of The Tamil Nadu Shops and Establishments Act, 1947 amended in 2018 by way of a bill, the said bill became an Act named The Tamil Nadu Shops and Establishments (Amendment) Act, 2023 effective 2nd July 2024.
- Effective 2nd July 2024, every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration and obtain a registration certificate.
2. What is the prescribed application form for registration?
- By virtue of Rule 2A of Tamil Nadu Shops and Establishments Rules, 1948, every application for registration of an establishment shall be made in Form-Y to the Inspector of the area in which the establishment is located. Every application under sub-rule (1), shall be made online together with a fee of Rs.100/- (Rupees one hundred only) through the designated web portal of the Labour Department.
3. How is the registration certificate obtained for new establishments?
- Every establishment employing ten or more workers shall, within a period of six months from the date of commencement of his business, apply for registration in Form-Y and obtain a registration in Form-Z. Issue of registration certificate for establishment is governed by Rule 2B wherein the Inspector shall issue registration certificate online in Form-Z within twenty-four hours from the time of making of the application under rule 2A.
4. How is the registration certificate obtained for already existing establishments?
- Rule 2C governs intimation of existing establishments. The employer of every establishment in existence on the date of commencement of the Tamil Nadu Shops and Establishments (Amendment) Act, 2018, that is effective 2nd July 2024, shall furnish online, through the designated web portal of the Labour Department, details of the establishment in Form ZB to the Inspector of the area in which the establishment is located.
